Common questions

Frequently asked

Do I have to go to court for a property settlement?+

Most property settlements are resolved by negotiation and formalised in consent orders without contested court appearances. We pursue that path first.

How is property divided after separation in Queensland?+

Australian family law uses a four-step process: identify the asset pool, assess contributions, consider future needs, and make a just and equitable adjustment. There is no automatic 50/50.

Do I need a binding financial agreement?+

If you are entering a relationship with significant pre-existing assets, a blended family, or a substantial inheritance expectation, a BFA can protect what you bring in. They are also useful at separation as a fast alternative to consent orders.

How long do I have to start a property claim after separation?+

12 months from divorce for married couples, and 2 years from separation for de facto couples. Bring it to us early — delays narrow your options.

Is everything I tell you confidential?+

Yes — communications with your lawyer are protected by legal professional privilege.
